The developers at Avalanche appear to be aware of the controversial subject matter with Rowling and made it clear in the Frequently Asked Questions page that the author is not directly involved in the creation of the game but she supports the studio that is making it. However, the developers also make it clear that the game is firmly set within the world that Rowling created. Elements and lore established in Rowling’s novels are used as the basis to create the entire game.
The controversial author may not be directly involved in Hogwarts Legacy, the game is still very much rooted in Rowling’s creations. It’s ultimately up to the individual player if they still wish to support Hogwarts Legacy or not.
